
Additional Tech and Education: The post-holder must be called to the Bar in a Commonwealth jurisdiction. A certificate or diploma in legislative drafting is preferred, or specialized post graduate training is essential. A minimum of ten (10) years' relevant post-qualification experience in the drafting of legislation in a Commonwealth jurisdiction is required for the post. This experience must include three (3) years management at a senior level in a legal environment with responsibility for the professional development of staff.
The Chief Parliamentary Counsel works under the policy direction of the Attorney-General and in accordance with Ministerial policies and procedures, to be accountable for the management and implementation of Government's legislative programme, to ensure the provision of a range of professional legislative drafting services and provision of legal advice to Cabinet Ministers, Ministries, Departments and His/Her Excellency the Governor in a timely and efficient manner. The Chief Parliamentary Counsel is accountable for the effective management and administration of the operations of the Legislative Drafting Section, including the financial, human resources and development functions, the maintenance of the legislative database and the revision and maintenance of Bermuda's laws. The Chief Parliamentary Counsel undertakes associated legal and operational duties, as requested by the Attorney General and Permanent Secretary responsible for the Attorney-General's Chambers. The post holder is ultimately responsible for the output of the Legislative Drafting Section, and makes professional decisions with respect to this critical function, including allocation of necessary resources. These decisions have a significant impact on the implementation of Government's economic and social policies as well as on the operation of Government. The post holder makes the final decisions with respect to the drafting of legislation, including determining the best legislative approach in context of the laws of Bermuda and the Constitution, the structure and language of the legislation, and all legal issues arising. The Chief Parliamentary Counsel gives legal advice to and on behalf of the Attorney-General. The Attorney-General as regards legislation and legal advice. As Head of the Legislative Drafting Section within the Attorney-General's Chambers Department, for administrative matters, the post holder reports to the Permanent Secretary responsible for the Attorney-General's Chambers.
